What To Know About Workers’ Compensation

What To Know About Workers’ Compensation

You probably have many questions about your work injury. The Colorado Springs and Southern Colorado workers’ compensation attorneys at Weddell & Haller, P.C., are here to answer your questions and help you begin the road to recovery. Below are some of the common questions that our clients ask us. For more information concerning these topics, please contact us.

1. What Doctor Will Treat My Work-Related Injury?

In Colorado, your employer has the right to select the doctor who will treat your work-related injury. But, your employer must give you a list of at least two doctors or clinics immediately upon notice of your injury. This is very important. You do have a choice, and if your employer fails to follow these and other requirements, you may have the right to choose your own treating physician. There are strict time limits within which you must act if you want to consider changing doctors. Contact Weddell & Haller for more information concerning this important right.

2. Can I Be Reimbursed For Mileage?

You are entitled to round-trip mileage reimbursement for ANY medical appointments, such as doctor appointments, physical therapy and diagnostic tests. Weddell & Haller will provide mileage forms to you and will assist in submitting your mileage records to the insurance company, with direct reimbursement to you. No attorney fees are charged for this service.

3. What About My Lost Wages?

You are entitled to temporary wage benefits if you are injured on the job and unable to return to work, or your employer does not offer you modified work, sometimes referred to as “light duty” work. Your temporary wages are based upon your earnings on the job. Colorado law requires that the calculation of your earnings must include any overtime work. Wage calculation must also include income from a second job. If you are receiving other benefits from your employer such as health insurance, meals or lodging, the value of these benefits may be included in your wage calculations. The Colorado Springs and Southern Colorado workers’ compensation attorneys at Weddell & Haller will help you maximize this important right. For more information and for assistance on your case, please contact Weddell & Haller.

4. When Should I Hire An Attorney?

If you are injured while working, it is best to seek legal advice as soon as possible. You have many rights under Colorado’s workers’ compensation law but there are time limits which can affect those rights. It is highly recommended that you seek legal representation as early as possible.
