The importance of workers’ compensation for Colorado workers

On Behalf of | Dec 14, 2018 | Firm News, workers' compensation disability

Workers’ compensation benefits are important benefits for Colorado workers and are a benefit they should thoroughly understand. Because so many workers spend most days at their jobs, it is important that they know what protections are available when they have suffered a workplace injury or illness.

Workers’ compensation disability is one important protection for injured workers. Colorado requires employers with greater than one part-time or full-time employee to carry workers’ compensation insurance for their employees. Workers’ compensation provides benefits regardless of fault, however, injured workers are unable to bring a personal injury claim for damages against the employer if they are receiving workers’ compensation benefits.

There are important requirements that must be met and steps to follow to receive benefits. To receive the maximum amount of benefits, the injured worker must notify their employer in writing within 4 days of suffering the workplace injury and has 2 years to file a claim for workers’ compensation benefits if the employer fails to file one. With a reasonable excuse, the injured worker may have 3 years to file a claim for workers’ compensation benefits if the employer fails to file one. Workers’ compensation benefits that may be available include benefits for healthcare expenses, temporary disability, permanent disability and death benefits. Benefits for disability include wage replacement benefits.

Injured workers have important rights to consider when they have been injured on the job in Colorado. It is essential for them to be familiar with the options available to help them, including workers’ compensation benefits and to be aware of what workers’ compensation benefits can do for them.
